The sale of share deeds can cause problems from time to time. Within the framework of legal practices, in some cases, even if the title deed is transferred, these sales can be canceled. What are the things that are curious about the sale of share deeds?
The title deed system, which also means the identity document of real estate in Turkey, continues to be implemented as a highly developed independent system. Two different title deeds can be created for real estate. In this context, depending on the number of property owners, the title deeds can be shared or detached. More than one person has the right of ownership over a deed that owns a share deed. Therefore, a kind of partnership is established on these deeds. In this way, the sale of the share shares of the real estate with title deeds can also be done within the framework of certain special rules.
HOW IS THE SALE OF SHARE TITLE DEEDS MADE, WHAT SHOULD BE CONSIDERED?
Those who own shares in a share deed may want to sell the parts of their shares. However, very different rules apply to this sales process. A detached title deed can be sold by the title deed owner as desired. In the sale of joint title deeds, the business changes and the right of restitution comes into play. Since the right to freedom is a very comprehensive right, those who sell without respecting this right may face heavy costs.
In the case of share deeds, the right of pre-emption is the right of pre-emption. If a share of a real estate is to be sold, the right to purchase this share is first given to other shareholders. If they do not want to use this right, then sales can be made to third parties. Therefore, the sale must be made to shareholders with an offer and it is important that this offer is made through a notary public in order to convert it into a written document. If this offer is not made and the title deed is sold to a third party, then things will get very complicated.
Shareholders may request the cancellation of the transfer of the title deed by claiming that the share of the title deed has been sold to a third party without their knowledge. In this case, the court will cancel the registration of the title deed. However, the process is not completed with such a simple cancellation decision. The share of shares sold is sold to the shareholders. The sales value is the sales price shown in the deed. The loss of those who show the sale price low in order to pay less expenses is much greater.
